As by entering to or ordering from this website you are deemed to have accepted these conditions. These Terms and Conditions bound to all Windragon Pty Ltd transactions incorporating but not limited to online, fax, phone, agent, trade fair and email ordering.
We reserve the right to make amendments to these Terms & Conditions at any time simply by posting the amended terms on our site. Any changes made will be effective immediately after they are posted. The Terms and Conditions explained here in are governed by the applicable statutory rules and regulations enforced by the Federal Government of Australia and the applicable State Government of the user purchasing the goods.
When using our website, you are deemed to agree to provide true, accurate, current and complete information about yourself as prompted by the website’s registration form. To register you must provide your real name and email address. If the information you provide is untrue, inaccurate, not current or incomplete; or Windragon Pty Ltd has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Windragon Pty Ltd has the right to suspend or terminate your account and refuse any and all current or future use of the website or any portion thereof.
Further, if you use this website, you are responsible for maintaining the confidentiality of your information provided and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
Any material in this website including images, illustrations, designs, icons, photographs and written material etc are owned by Windragon Pty Ltd. You may not copy, publish, modify, create derivative works from, and exploit in any way any of the contents. Orders and account credit application
All new customers commence on Proforma terms for a minimum of up to 3 invoices. Only then is the customer eligible to apply to open an account with Windragon Pty Ltd by completing in full a “New Account/Credit Application Form”.
A Proforma customer will be granted a 30 Day (from Invoice) account and their status changed to Net 30 days only when the above conditions are met and they are successful in their application for an account. However, Windragon Pty Ltd reserve the right to refuse any company an Account if the above conditions are not met in full. All orders which are endorsed or described as Proforma Orders are firm, binding and non-cancellable by the purchaser and must be paid for in full within 7 days from date of invoice to ensure delivery of all available product. Where payment for a Proforma Order is not received within 30 days of the date of invoice, the order may be cancelled by and at the sole discretion of Windragon Pty Ltd. In such an event the purchaser will be liable from the date of notice of cancellation for a cancellation fee equivalent to 15% of the invoiced cost or $45.00, whichever is greater for stock ordered on your behalf. We suggest, in order to encourage prompt dispatch of goods, that the purchases provides credit card details upon placement of order. The credit card will be processed when goods are dispatched. Credit card information will not be retained for future use.
To open a 30-day trading account, you must complete a Windragon Pty Ltd Credit Application form in full and return back to be approved. Please contact Head Office for Credit Application form. All account payments are strictly 30 days from date of invoice. Please read our privacy statement about how we protect the customer information.
Pricing
All pricing on Windragon Pty Ltd website is in Australian Dollars (AUD) and exclusive of GST. Prices shown were deemed correct at the time of showing. However, errors and omissions, fluctuating currencies and other factors may occur so we reserve the right to make changes of prices and product specifications at any time without prior notice.
Products
Every effort has been taken to display as accurately as possible product descriptions, dimensions and colour finishes on this website. The actual colours you see will depend on your computer/monitor and Windragon Pty Ltd does not guarantee that your monitor’s display of any colour is true and accurate.
Returns & Credits
1. We do not exchange, refund or credit for incorrect selection. Any goods purchased from Windragon Pty Ltd may only be returned or claimed if found to be damaged, faulty or incorrectly supplied. We only accepted if authorised by Windragon head office, and are notified within 7 days of receipt of goods. Notification of a claim must be made by email/fax along with the images to head office. Failure to claim within this period constitutes full acceptance of the goods. The goods must be in their original packaging in which they were shipped when returning goods, after authorisation has been given. Customers are responsible for all freight costs when returning non- damaged, perfect quality or correctly supplied goods and all returns must be sent to Windragon (Head Office/Warehouse) in Melbourne complete with authorization. Windragon Pty Ltd reserves the right to deny a credit for returned goods found NOT to be in perfect order and without authorization. NO Credit’s, Return’s or Exchange are offered on sale items. Windragon sales representatives and sales agents will not accept return of claimed goods unless authorization from Windragon head office is given.
2. Unless the product is defective or the return is a direct result of a Windragon error, Windragon may charge a restocking fee of up to 20% of the purchase price paid less shipping and handling, plus any applicable sales tax, which would be applied through a total reduced refund or credit.
Delivery
All orders are subject to a Freight charge. Freight is calculated on the size of the consignment (which ever is greater, cubic or weight measurement). All orders will be dispatched approximately 1 – 5 working days from receipt of order subject to the availability of products ordered.
Windragon Pty Ltd sends all orders via a common carrier to ensure fast & safe delivery. All orders both domestic and international MUST be delivered to a business address.
We are able to deliver to Residential addresses however conditions apply.
All delivery addresses given to Windragon Pty Ltd are deemed to be business addresses unless otherwise advised. A non negotiable condition of all deliveries to residential addresses is that they are sent with ‘Authority To Leave’ if no-one home. Once the courier has delivered the goods, we will have no further responsibility for their loss or damage here after.
For all deliveries detailed above it is the responsibility of the customer to check that all cartons are accounted for before signing for the delivery. A signed “Proof of Delivery” (POD) will be used to determine the delivery of an order. Windragon Pty Ltd does not accept responsibility for goods that are misplaced after they have been delivered and signed for including residential deliveries.
If you wish to use your own courier please advise upon receipt of order. We will simply liaise with your courier regarding pick-up of the order from our warehouse. Once we have delivered goods to your courier or they have picked the goods up, we will have no further responsibility for their loss or damage whilst in transit.
Deliveries to most Capital cities in Australia take approximately 2-4 working days. For urgent delivery requests please note that Windrago Pty Ltd will make effort to dispatch orders on time, however we can’t guarantee the nominated freight company will deliver on time as requested. We are also unable to request the courier to call before delivery. Please understand that as we use a third party for deliveries we are unable to guarantee an exact delivery date, once the goods leave our premises, circumstances may arise which are outside of our control. Please call us if you have not received your order within 7 working days of placing your order or if you have any concerns at all.
Payment
Payment can be made to the EFT credit card, (visa, master card) or cheque or cash
An account is considered overdue if unpaid 31days from the date of Invoice. We reserve the right to stop supply, cancel an account or simply place any account considered overdue back on Proforma terms until such time we feel you are capable of paying within our terms .
Further and in accordance with the ‘Procurement 30 Day Payment Policy for Small Business’ introduced by the ATO in effect of 1st December 2008 we reserve the right to charge a Late Payment Interest fee on all accounts that lapse into 90 days. Interest will be charged daily for each day the account has been overdue and billed at the end of the month in the form of a Tax Invoice [excl. GST] and sent with your month-end statement. Where the Late Payment Interest is calculated and is below $10.00 an Administration Fee of $10 will apply instead. The general interest rate we will use to calculate the Late Payment Interest is updated by the ATO quarterly and is available from the Australian Taxation Office website. Where final outstanding amounts are made before month-end you will be required to notify us so a Tax Invoice for Late Payment Interest can be issued prior to final payment. We also reserve the right to charge an account-keeping fee of $10 per month on overdue balances to assist with collection costs.
All goods remain the property of Windragon Pty Ltd and the Title in any goods does not pass to the Purchaser until all debts owed to Windragon Pty Ltd on any account whatsoever, including Interest, Bank Charges, Legal Fees and Collection Expenses are paid in full. In this regard the Purchaser grants the right for Windrago Pty Ltd to enter the Purchaser’s premises, or any other premises where the goods are reasonably believed to be stored, without notice, to take possession of the goods.
Privacy Policy
Windragon Pty Ltd will keep the customer information safely, and will not disclose your personal details to any third party organisations or individuals, other than third party suppliers in the delivery of goods you have agreed to, or when legally required.
